Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website center42.tech (the "Site") and the educational and consulting services offered through it (the "Services"). Please read them carefully. By using the Site, registering for a program, or purchasing a service, you agree to these Terms.

1. Who we are

The Site and Services are operated under the brand name Center42 by:

In these Terms, "Center42", "we", "us", and "our" refer to the above entity.

No affiliation. Center42 is an independent business. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to any other company, brand, product, or organization that uses the number "42" in its name, branding, or domain. Any similarity is coincidental.

2. Our Services

Center42 provides:

  • Educational programs, including cohort-based acceleration and startup programs, training, workshops, and related educational content for entrepreneurs, founders, and startups; and
  • Consulting and advisory services, including strategic, business-development, and product-management advisory engagements.

The specific scope, format (online, in person, or hybrid), schedule, duration, and deliverables of any program or engagement are described at the point of purchase or in a separate agreement, order form, or program description, which forms part of these Terms for that purchase.

3. Eligibility

To use the Services you must be at least 18 years old and have the legal capacity to enter into a binding contract. If you act on behalf of a company or organization, you confirm you are authorized to bind that entity.

4. Registration and enrollment

Some Services require you to register or enroll. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for any activity that occurs under your account or enrollment. A contract between you and Center42 is formed when we confirm your enrollment or order, or when the Service begins, whichever is earlier.

5. Fees and payment

  • Prices and fees for programs and services are stated on the Site or in the applicable order form or proposal.
  • Unless stated otherwise, fees are due at the time of enrollment or as set out in the applicable engagement terms.
  • Payments are processed by third-party payment providers (e.g., Stripe). By paying, you also agree to the payment provider's terms. We do not store full card details.
  • We will issue invoices in accordance with applicable Polish tax law. Please provide any business/VAT details required for invoicing at the time of purchase.

6. Right of withdrawal (consumers)

If you are a consumer within the meaning of applicable EU and Polish law, you generally have the right to withdraw from a distance contract within 14 days without giving a reason.

  • To exercise this right, send a clear statement of your decision to withdraw to contact email mentioned in section 1 before the period expires.
  • Digital content and services that begin during the withdrawal period: If you expressly request that a Service (e.g., a program or session) begins before the 14-day period ends, and you acknowledge that you will lose the right of withdrawal once the Service is fully performed, the right of withdrawal does not apply to the part already performed. Where a Service is partially performed at your request, you may owe a proportionate amount for what has been provided.

This section does not apply to clients who purchase as businesses (B2B), unless we agree otherwise in writing.

7. Cancellations and refunds

  • Refund and cancellation terms specific to a program or engagement are set out at the point of purchase or in the applicable order form, and apply in addition to any statutory withdrawal rights above.
  • Where no specific policy is stated: requests to cancel and refund made 714 days before a program start date will be refunded in full; cancellations after that point may be subject to a partial refund or no refund, reflecting costs already incurred and Services already delivered.
  • We reserve the right to reschedule or cancel a program. If we cancel a program in full, you will receive a full refund of fees paid for that program.

8. Your responsibilities and acceptable use

You agree to:

  • use the Site and Services lawfully and in line with these Terms;
  • not disrupt, damage, or attempt to gain unauthorized access to the Site, its systems, or other users' data;
  • not copy, resell, redistribute, or commercially exploit our content or program materials except as expressly permitted; and
  • participate in programs respectfully and refrain from harassing, abusive, or unlawful conduct toward staff, mentors, or other participants.

We may suspend or terminate your access or enrollment if you materially breach these Terms.

9. Intellectual property

All content, materials, curricula, frameworks, templates, presentations, and other works made available through the Services are owned by Center42 or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use program materials solely for your own personal or internal business learning purposes. You may not reproduce, distribute, publicly share, or create derivative works for commercial purposes without our prior written consent.

Any materials, ideas, or business information you submit remain yours; you grant us a limited license to use them only as needed to deliver the Services to you.

10. No guarantee of results

Our educational and consulting Services provide information, guidance, frameworks, and advisory support. They do not guarantee any specific business, financial, fundraising, investment, commercial, or career outcome. Decisions you make based on the Services are your own responsibility. The Services do not constitute legal, tax, accounting, investment, or other regulated professional advice unless expressly stated and provided by a qualified professional.

11. Disclaimers

The Site and Services are provided on an "as is" and "as available" basis. To the extent permitted by law, we make no warranties that the Site will be uninterrupted, error-free, or free of harmful components, or that the Services will meet your particular requirements. Nothing in this section limits any rights you have as a consumer under mandatory law.

12. Limitation of liability

To the fullest extent permitted by applicable law:

  • We are not liable for indirect, incidental, or consequential losses, lost profits, lost business, or loss of data arising from your use of the Site or Services.
  • Our total aggregate liability arising out of or relating to a given program or engagement is limited to the amount you paid us for that program or engagement.

Nothing in these Terms excludes or limits our liability where it cannot lawfully be excluded or limited, including for intentional fault or for liability that cannot be limited under mandatory Polish or EU consumer law.

13. Data protection

We process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Polish law. Details of how we collect, use, and protect your personal data are set out in our Privacy Policy: http://center42.tech/en/privacy-policy

14. Complaints

If you have a complaint about the Services, please contact us at contact email. We will acknowledge and aim to respond to complaints within 141 days.

15. Changes to these Terms

We may update these Terms from time to time. The version in force at the time you purchase a Service applies to that purchase. We will post the current version on the Site with an updated effective date. Material changes will not retroactively reduce rights for Services already purchased.

16. Governing law and jurisdiction

These Terms are governed by the laws of Poland. Mandatory consumer-protection provisions of the country where a consumer resides continue to apply where applicable. Disputes will be subject to the competent courts of Poland, subject to any mandatory rules granting consumers the right to bring proceedings in their place of residence.
